Terms of service
All coaching, education, experiences, and entertainment services and communication, email or otherwise, delivered by Calee Lucht, Calee Lucht Enterprises, LLC (your “Coach”), as well as information set forth on her website (caleelucht.com) or other websites promoting her services are meant to help you identify the areas in your life and in your thinking that may be standing in your way. However, coaching is not professional mental health care or medical care. If you feel psychologically stressed to the point that it is interfering with your ability to function, please seek the help you need in the form of a professional counselor. Coaching may augment your therapy, but the work of coaching is meant to be done when major emotional and psychological wounds are already healing or healed.
By purchasing coaching services from your Coach, you confirm that you have read and agree to each statement and that you wish to proceed:
You understand that the services you will be receiving from your Coach are not offered as a substitute for professional mental health care or medical care and are not intended to diagnose, treat or cure any mental health or medical conditions. You also understand that your Coach is not acting as a mental health counselor or a medical professional.
You understand and agree that you are fully responsible for your well-being during sessions, and subsequently, including your choices and decisions.
You understand that coaching is not a substitute for counseling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment, and you will not use it in place of any form of therapy.
You understand that all comments and ideas offered by your Coach are solely for the purpose of aiding you in achieving your defined goals. You have the ability to give your informed consent, and hereby give such consent to your coach to assist you in achieving such goals. Outcomes are not guaranteed.
You understand that to the extent our work together involves career or business, your Coach is not promising outcomes including but not limited to increased clientele, profitability and or business success.
You understand that your Coach will protect your information as confidential unless you state otherwise in writing. If you report child, elder abuse or neglect or threaten to harm myself or someone else, you understand that necessary actions will be taken and your confidentiality agreement limited in this capacity. Furthermore, if your Coach is ordered by a court to provide information or to testify, she will do so to the extent the law requires.
You understand that the use of technology is not always secure and you accept the risks of confidentiality in the use of email, text, phone, video, and other technology.
You hereby release, waive, acquit and forever discharge your Coach, any agents, successors, assigns, personal representatives, executors, heirs and employees from every claim, suit action, demand or right to compensation for damages you may claim to have or that you may have arising out of acts or omissions by yourself or by your Coach as a result of the advice given by your Coach or otherwise resulting from the coaching relationship contemplated by this agreement. You further declare and represent that no promise, inducement or agreement not expressed in this agreement has been made to you to accept this agreement. This agreement shall bind your heirs, executors, personal representatives, successors, assigns, and agents.
You agree that the exercises and materials shared are considered intellectual property. In entering a coaching relationship with Calee Lucht, you agree that you will not share, but use solely for your own personal and professional development.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall Calee Lucht Enterprises, LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
